Intentional Torts

An intentional tort occurs when someone purposefully does something to harm another. An intentional tort is inherently more “evil” than the tort of negligence. The tort of negligence deals with accidents; an intentional tort is no accident.

If you believe that someone hurt you on purpose, you may be able to sue that person based on the legal theory of intentional tort. In order for an injury victim to win a lawsuit based on the Defendant’s intentional tort, the victim must be able to prove three things:

  1. Some physical act of the Defendant;
  2. That the Defendant committed such act intentionally; and
  3. That such intentional act actually caused some injury to the victim.
